Data, Security & Liability Disclaimer

Entity: [PumaServers, LLC] (“PumaServers,” “we,” “us,” or “our”)

By using any PumaServers services—including VPS, dedicated IPs, networking, bandwidth, storage, or related support (collectively, the “Services”)—you agree to the terms below. If you do not agree, do not use the Services.

1) You are responsible for your data

Your Content. You (not PumaServers) are solely responsible for all data, code, files, logs, configurations, applications, and content you store, process, transmit, or make available via the Services (“Customer Data”).

Security Measures. You are solely responsible for securing Customer Data, including but not limited to: encryption (in transit and at rest), key management, backups, redundancy, access controls, patching, malware protection, firewalling, secure configuration, and credential hygiene.

No Managed Backups. Unless you purchase a separate, written backup service from us, we do not provide or guarantee backups. You must maintain your own independent, tested backups and disaster-recovery plan.

2) No responsibility for loss, corruption, or unauthorized access

To the maximum extent permitted by law, PumaServers is not liable for any loss, corruption, exposure, unauthorized access, breach, destruction, or unavailability of Customer Data, regardless of cause, including (without limitation): your actions or omissions; third-party acts; hardware failure; software bugs; misconfiguration; updates or patches; power loss; network or internet issues; DDoS or other attacks; malware or ransomware; abuse or activities by your users; maintenance windows; suspension/termination; force majeure; or events outside our reasonable control.

3) Service interruptions

The Services may be unavailable, limited, or degraded from time to time. We do not guarantee uninterrupted or error-free operation, specific latency, bandwidth, or performance levels unless we have a separate, written SLA with you. Scheduled or emergency maintenance may occur without notice where permitted.

4) No regulated-data commitments (unless agreed in writing)

Unless we have a separate, signed agreement explicitly stating otherwise, the Services are not designed for and we do not agree to obligations under sectoral laws or standards such as HIPAA, GLBA, FERPA, CJIS, PCI DSS, or similar frameworks. Do not upload regulated data to the Services without first obtaining our written approval and entering the required agreements.

5) Third-party software and networks

Any software, images, OS templates, packages, repositories, container images, scripts, or other materials you install or use are your responsibility. We are not responsible for third-party services, networks, or registries, and we make no warranties about their security, availability, or fitness.

6) Content and acceptable use

You must comply with applicable laws and our Acceptable Use Policy (AUP) (e.g., no spam, abuse, DDoS, malware, illegal content, or infringement). You are responsible for the acts and omissions of anyone who uses your instances, IPs, or credentials.

7) No warranties (AS IS / AS AVAILABLE)

The Services are provided “AS IS” and “AS AVAILABLE,” without any warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.

8) Limitation of liability

To the maximum extent permitted by law:

To indirect damages. PumaServers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or replacement costs, even if advised of the possibility.

Cap. Our total liability for all claims in the aggregate arising out of or relating to the Services will not exceed the amount you paid to PumaServers for the affected Services in the twelve (12) months immediately preceding the event giving rise to the claim.

Carve-outs. Some jurisdictions do not allow certain limitations; in those places, our liability will be limited to the maximum extent permitted by law. Nothing here limits liability for gross negligence or willful misconduct to the extent such limitation is prohibited by law.

9) Indemnification

You agree to defend, indemnify, and hold harmless PumaServers and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Customer Data; (b) your use or misuse of the Services; (c) breach of this Disclaimer, our AUP, or applicable law; or (d) any dispute between you and your users, customers, or licensees.

10) Suspension and removal

We may suspend or terminate Services (with or without notice, consistent with applicable law) for security reasons, abuse, non-payment, legal requests, risk management, or AUP violations. We may also remove or disable access to content alleged to be infringing or unlawful.

11) Data retention after termination

Upon termination or expiration of Services, we are not obligated to retain your Customer Data. We may delete Customer Data without liability after a commercially reasonable period. Export your data before termination.

12) Notifications of incidents

If we become aware of a security incident affecting our infrastructure that materially impacts your use of the Services, we will provide notices as required by law. Our provision of notice does not constitute an admission of fault or liability.

13) Changes

We may update this Disclaimer from time to time. Changes become effective on posting to this page with an updated “Effective date.” Your continued use of the Services after the Effective date constitutes acceptance of the changes.

14) Governing law & venue

This Disclaimer and any disputes arising from it or the Services are governed by the laws of [State/Country], without regard to conflicts-of-law rules. Exclusive venue and jurisdiction reside in the courts located in [County, State/Country]. You consent to personal jurisdiction in those courts.

Fulfillment and Refund Policy

1. Fulfillment Policy

At Puma Servers LLC, we strive to provide fast and reliable virtual private server (VPS) provisioning to our customers. All VPS orders are processed and provisioned within one (1) hour of payment confirmation, except on weekends, where provisioning may take longer. Customers will receive their VPS login credentials via email once provisioning is complete.

If, for any reason, we anticipate a delay beyond our standard provisioning time, we will notify the customer promptly via email.

2. Refund Policy

We are committed to customer satisfaction. If you are not fully satisfied with your VPS service, you may request a full refund within 24 hours of your purchase. Refund requests must be submitted to our support team via [support email or ticket system].

Refund requests made beyond the 24-hour window will not be honored. Additionally, refunds do not apply in cases where the service was used in violation of our Terms of Service.
